This Privacy Policy and Consumer Health Data Privacy Notice (this “Policy”) describes how Prime Physiques LLC (“Prime Physiques,” “Company,” “we,” “us,” or “our”) collects, uses, retains, discloses, and otherwise processes Personal Information when an individual (“you” or “Consumer”) accesses or uses our websites, including https://primephysiques.net and https://macros.primephysiques.net, submits information through our forms or calculators, receives communications from us, purchases or uses our services, participates in a coaching program, or otherwise interacts with us (collectively, the “Services”).

This Policy includes our Consumer Health Data Privacy Notice (Section 7) and is intended to address applicable consumer privacy and consumer health data requirements, including Nevada law (NRS 603A) and other applicable state consumer health data statutes, to the extent such laws apply.

At or before the time of collection, Prime Physiques may collect the following categories of Personal Information:

We collect and use these categories of information to operate the Services; calculate personalized macronutrient and caloric reports; provide coaching and training services; manage client accounts, payments, and subscriptions; communicate regarding requested materials; send optional marketing communications where authorized; maintain security; prevent fraud; comply with legal obligations; and enforce our legal agreements.

Prime Physiques does not sell Consumer Health Data or Personal Information for monetary consideration. We retain each category of information only for as long as reasonably necessary to accomplish the purposes stated in this Policy, fulfill contractual obligations, comply with tax and statutory requirements, establish or defend legal claims, and protect the Services.

2. Scope and Controller

Prime Physiques LLC is the entity responsible for the Personal Information processed under this Policy. This Policy applies to all digital tools, websites, landing pages, forms, and coaching Services controlled by Prime Physiques. It does not govern the independent privacy practices of third-party websites, applications, platforms, or services that we do not control.

For purposes of this Policy:

“Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with an identified or identifiable individual or household.

“Consumer Health Data” means Personal Information that is linked or reasonably linkable to a Consumer and identifies or may be used to identify, infer, or determine the Consumer’s past, present, or future physical or mental health status, bodily functions, measurements, health-related condition, activity, nutrition, fitness status, or use of health-related services, as defined by applicable law (including NRS 603A and other applicable state consumer health data statutes).

“Process” or “Processing” means any operation performed on Personal Information, whether or not by automated means, including collecting, accessing, retaining, using, analyzing, deriving, inferring, storing, transmitting, disclosing, deleting, or otherwise handling such information.

This Section 7 serves as Prime Physiques LLC’s dedicated Consumer Health Data Privacy Notice under Nevada SB 370 and other applicable state consumer health data statutes.

7.1 Categories of Consumer Health Data Collected

We collect age, biological sex or gender information, physical measurements (height, weight, body composition), activity levels, exercise history, dietary parameters, fitness goals, derived metabolic calculations (BMR, TDEE, macro targets), and health-related inferences drawn from intake forms.

7.2 Sources & Purpose of Health Data Processing

Consumer Health Data is collected directly from you via calculator forms, intake questionnaires, and coaching applications. We process Consumer Health Data strictly to generate and deliver your personalized macronutrient report, provide custom fitness coaching, and fulfill requested services. We do not collect or process Consumer Health Data for secondary marketing purposes without obtaining separate, explicit opt-in consent.

7.3 Data Processors & Software Restrictions

We share Consumer Health Data only with contracted processors necessary to run our platform (Lovable, Anthropic/Claude API, Mailchimp, Typeform, and Trainerize) pursuant to binding contracts consistent with applicable consumer health data law. Processors are strictly prohibited from using Consumer Health Data for independent commercial purposes, advertising profiling, or AI model training.

We will verify your identity and fulfill authenticated requests free of charge within 45 days. To appeal a decision regarding a request, email jalendinardo@primephysiques.net with the subject line “Privacy Appeal.”

8. Email and Marketing Communications

Enrolling in ongoing commercial marketing emails requires an unbundled, explicit opt-in selection on our forms. You may unsubscribe from marketing communications at any time by clicking the "Unsubscribe" link at the bottom of any email. Unsubscribing from marketing does not prevent us from sending essential transaction messages (such as delivery of a requested report, account notifications, or billing receipts).

Prime Physiques LLC provides fitness, nutrition, body-recomposition, and wellness coaching. Prime Physiques LLC is not a medical clinic, healthcare provider, or covered entity under the Health Insurance Portability and Accountability Act (HIPAA).

Calculations, macronutrient targets, and coaching outputs provided through the Services are for educational and informational purposes only and do not constitute medical advice, diagnosis, or treatment. You should consult a qualified physician before starting any diet or exercise program.

10. Media, Testimonials, and Transformation Content

Photographs, videos, written testimonials, reviews, and transformation materials provided by clients are processed and used in accordance with the Prime Physiques LLC Client Agreement, which includes a mandatory Media, Testimonial & Transformation Content License as a condition of service.

11. Data Retention, Security, and Incident Response

We implement reasonable administrative, physical, and technical safeguards designed to protect Personal Information against unauthorized access, destruction, or disclosure. Information is retained only as long as necessary to deliver services, comply with legal and tax obligations, resolve disputes, and enforce agreements.

Upon receiving a valid deletion request, health parameters are permanently erased from active production databases within 45 days. Following corporate relocation to Arizona, notice of unencrypted security breaches will be governed under applicable Arizona breach notification statutes (A.R.S. § 44-7501).

Prime Physiques is operated in the United States. If you access our Services from outside the United States, you acknowledge that your information will be transferred to and processed in the United States under local data protection standards.

13. Changes to This Policy

We may update this Privacy Policy and Consumer Health Data Privacy Notice from time to time. The updated version will be posted on this page with a revised "Last Updated" date. Continued use of the website or Services after changes are posted constitutes acceptance of the updated policy.
